Tally service terms

For businesses using Tally digital loyalty cards. Last updated 16 October 2026.

These terms are between Cyber-Jack ("we", "us"), a UK software studio reachable at [email protected], and the business that sets up a Tally loyalty programme ("you"). Plain English on purpose: if anything is unclear, ask us.

1. The service

  1. Tally gives your customers a digital stamp card in their web browser, and gives you a staff dashboard to stamp cards, redeem rewards, run offers and birthday treats, and see your members.
  2. We aim to keep Tally available at all times but cannot promise it will never be interrupted. We will tell you about planned work in advance where we can.
  3. We may improve or change features. We won't remove a core feature (stamping, rewards, member list) without giving you at least 30 days' notice.

2. Your trial and payment

  1. New businesses get a free trial (normally 30 days). We don't take card details to start a trial.
  2. After the trial, Tally is a monthly subscription at the price agreed with you or shown when you subscribe. You can cancel any time; the cancellation takes effect at the end of the month you've paid for.
  3. If you don't subscribe or a payment fails, we may pause your staff dashboard after giving you notice. We will not delete your members' cards for at least 60 days after that, so you can come back or take your data with you.

3. Your responsibilities

  1. Keep your private owner link safe and only share it with your staff. Anyone with it can run your programme. Tell us straight away if you think it has leaked and we'll issue a new one.
  2. Honour the rewards, treats and offers you show to customers, and make sure your offers are lawful and accurate.
  3. Only send offer emails to members who opted in (Tally tracks this for you), and don't use members' details for anything unrelated to your loyalty programme.
  4. Don't use Tally for anything unlawful, or try to break or overload it.

4. Your data

  1. Your members' details belong to you. You can see and remove them at any time, and we'll give you a full export on request.
  2. When you leave, tell us and we'll delete your programme and all member data within 30 days (backups roll off within a further 30 days).

5. Data processing terms

For members' personal data, you are the controller and we are your processor under UK GDPR. Specifically:

  1. Subject matter and purpose: hosting and running your loyalty programme. Categories of people: your members. Types of data: name, mobile number, optional email, optional birthday (day and month), optional children's first names and birth months, visit and reward history, and marketing consent.
  2. We only process members' data on your documented instructions, which are these terms and the way you use the dashboard.
  3. Everyone at Cyber-Jack who can access the data is bound by confidentiality.
  4. We keep the data secure: it is stored in the UK, encrypted in transit (HTTPS), access-controlled, monitored, and backed up nightly.
  5. Sub-processors: Cloudflare (network and security), and Brevo (email delivery, only if offer emails are switched on for you). We'll tell you before adding or replacing a sub-processor so you can object.
  6. We'll help you answer members' requests (access, correction, deletion); members can also delete their own card directly.
  7. We'll tell you without undue delay, and within 48 hours of becoming aware, of any personal data breach affecting your members.
  8. Member cards with no visit for 24 months are deleted automatically. At the end of the service we delete or return the data as described in section 4.
  9. We'll give you the information you reasonably need to show you're meeting your own obligations.

You must tell your members how their data is used. Tally provides a ready-made privacy notice, linked from every card, that names you as controller. Check it fits your business.

6. Liability

  1. Nothing in these terms limits liability that can't legally be limited.
  2. Otherwise, our total liability to you in any 12 months is limited to the fees you paid us in that period, and we aren't liable for lost profits or indirect losses.

7. Ending the service

You can stop at any time. We can end the service with 30 days' notice, or straight away if you seriously break these terms. These terms are governed by the law of England and Wales.
